December 19, 2024 – Tables turn on cheney

It was June 2021 when then-Representative Liz Cheney colluded with Nancy Pelosi to create the January 6th Committee in the House with the unstated but express purpose of bringing down Donald Trump.  Just a short while later, it became obvious that they were going to attempt to use me as a weapon to get Trump. It was then when I was forced to create the John Eastman Legal Defense Fund to push back against the lawfare that was being orchestrated against me.

The J6 Committee under Co-Chair Cheney put me through hell. They made numerous false allegations, tried to force me to violate attorney-client ethical rules, implied that unless I cooperated with their witch hunt they would see that I was punished, and leaked materials to the press so that my name would be dragged through the mud and my reputation sullied.

I paid a terrible price because of Liz Cheney’s anti-Trump crusade, but I never buckled to her pressure.

That is why I read with great interest that the tables have turned on Ms. Cheney. A criminal referral has been made by the Committee on House Administration Subcommittee on Oversight for the Justice Department to investigate her actions.

Cheney helped instigate the lawfare attacks against me, but I am working hard to make sure her efforts do not succeed. Will you step forward today to support my legal defense fund? Unfortunately, we are nearly out of money and in urgent need of additional financial support. Please be generous.

As I said, it became obvious that Cheney, Pelosi and the Democrats saw me as a potential weapon they could use to take down President Trump.

They tried to force me to give them all my emails and other communications with President Trump, which I refused to turn over on the grounds that they were protected by the attorney-client privilege.

So Cheney and her J6 colleagues went instead to my former employer, Chapman University, which unbeknownst to me had archived and retained copies of all my client communications.  They were going to turn over 94,000 pages of documents without even reviewing them for attorney-client privilege, so I was ethically bound to sue to prevent that. 

In court, the leftwing committee alleged that there was good evidence to believe that Mr. Trump committed a crime, which could trigger the so-called “crime/fraud” exception to privilege. Cheney and her cohorts said that Mr. Trump, “obstructed, influenced or impeded, or attempted to obstruct, influence or impede…an official proceeding of the United States…and that the defendant did so corruptly.”

Shockingly, the judge hearing the case accepted their claims and ordered me to turn over about 200 pages (out of the original 94,000!) of my communications, which I had no choice but to do.

You won’t be surprised by what happened next given Liz Cheney’s maleficence.

While our appeal was pending, the Committee “inadvertently” leaked some of my confidential communications arising out of my representation of President Trump to the public, which led to an extraordinary series of vicious attacks in the press. I was smeared by media outlet after media outlet, which took great pleasure in falsely portraying me as a legal charlatan, someone who didn’t even believe my own advice to President Trump.

I shake my head at the incredible unfairness and gross misrepresentation of my legal scholarship and representation of President Trump.

That’s when the lawfare assault began in earnest, and Liz Cheney is in large part to blame for it.

I’ve now been implicated in alleged wrongdoing by Special Counsel Jack Smith, indicted in Arizona and Georgia, and had my California law license put on “temporary inactive status” while I appeal a recommendation that I be disbarred. I have had to raise and expend more than $1.5 million defending myself, and am looking at needing that much again (or more) before all is said and done.

I hope that President Trump’s DOJ does investigate Liz Cheney for potential criminal behavior when incoming Attorney General Pam Bondi takes office. If I am asked questions about my dealings with Cheney and her band of misfit J6 committee members during such an inquiry, I will be happy to tell them what I know.
