I’m pleased to report that my legal team and I have secured a major court victory in Arizona, SLAPPing back at the state Attorney General’s outrageous prosecution of me. That’s not a typo – SLAPP stands for Strategic Lawsuit Against Public Participation – and that is just what the AG’s prosecution of me in Arizona is all about.

Arizona’s anti-SLAPP statute specifically prohibits the prosecution of someone that implicates the expression of their first amendment rights. I filed a motion to dismiss the prosecution some time ago because it violates the state’s anti-SLAPP statute. We had to fight like heck to even get to the point where our motion was heard, but earlier this week we WON a major procedural battle that could be the first step in ending the prosecution of me in Arizona.
Fighting back against partisan leftwing prosecutors like Arizona’s Kris Mayes has cost me over $1.5 million thus far in legal fees and left my defense fund nearly exhausted. Will you step forward to help me fight Mayes and other partisan Democrat prosecutors who are out to ruin me? I need to raise more than $1.5 million in additional funds to fend off the attacks I am facing, and I urgently need your help.
There are two steps a defendant like me must cross in order to get a criminal prosecution dismissed based on a violation of the Arizona anti-SLAPP statute. The first is presenting prima facia evidence that my First Amendment rights have been implicated, as well as presenting substantial evidence that the state’s prosecution was to retaliate or deter those rights.
The new judge assigned to the case (replacing a clearly biased anti-Trump judge forced to remove himself) ruled this week that I have met my burden in this first critical step.
Now we must move to the second step where the burden shifts to the Attorney General where she must prove that she wasn’t motivated by a desire to retaliate or deter my First Amendment rights. Her brief is due on March 25th, which we will answer and vigorously contest.

To show you what I’m up against to defend my constitutional rights in Arizona, Mayes has vowed to appeal the judge’s ruling that I’ve met my burden establishing a prima facie case that the prosecution violates the anti-SLAPP statute. But more than that, she’s vowed to challenge the very constitutionality of the anti-SLAPP statute itself!
Think of the sheer chutzpah of what this partisan Democrat prosecutor is trying to do! The very lawyer who has sworn an oath to defend the duly enacted laws of the state of Arizona is now committed to challenging the constitutionality of a duly enacted law! Why? Because it could interfere with her nakedly-partisan attempt to bring down anyone associated with President Trump.
One of the reasons it has cost me so much to defend myself against the lawfare left is because partisan prosecutors like Kris Mayes can drag out the complexity of the case, and thus drive defense costs through the roof. This is part and parcel of the whole lawfare scam – make it so difficult and so costly for the accused to defend themselves that they eventually have to succumb and try to cut a deal.
But I return to the point I made at the beginning of this email – I have pledged to you and the American people that I will do everything in my power to defeat the lawfare left. As long as I have good and decent people like you standing by my side, I will never succumb, never surrender, and never settle.
