April 04, 2026 – So much for fringe

Left-wing activists, lawfare lawyers and many in the media have portrayed my position on birthright citizenship, which mirrors President Trump‘s Executive Order on the issue, as fringe and out of touch.

I was in the Supreme Court for yesterday’s oral argument and it seems clear that “fringe” is not even close to the seriousness with which the justices considered the arguments.

With millions of anchor babies born to aliens in the US illegally or temporarily, and in the face of documented “baby mills” designed to create US citizenship for children of Chinese nationals and other abusers, the Supreme Court carefully debated the issue.

I have attended many Supreme Court arguments, and this was one of the best, if not the best.  The attorneys on each side were well-prepared, knowledgeable and effective. All the justices asked serious questions, even the liberal justices.  They all seemed to be seriously weighing whether the framers of the Citizenship Clause of the 14th Amendment intended to grant automatic US citizenship to children who are born here to illegal aliens who had no intention to be permanently domiciled in America.

The ACLU quickly took to the media to claim they had won the day, but that’s like CNN saying radicals are engaged in “mostly peaceful protests” when buildings all around are burning to the ground.

It seems clear that the justices are split. I don’t know which side will ultimately win when this case is decided, likely in late June, but I can say this: my scholarship and President Trump’s Executive Order has caused the nation, Congress and the judiciary to seriously consider what needs to be done to end the abuses we are seeing.

We have the children of criminal cartel leader El Mencho born in California to an illegal alien mother who then immediately returns to Mexico where she, and eventually the children, help run the cartel. We have Chinese billionaires who pay American women working in Chinese-owned surrogacy clinics to have their children who are shortly sent back to China to be raised under the CCP. And we have at least 500 Chinese baby tourism companies who arrange for pregnant women to come here “to visit” and then give birth on US soil. Some estimates are that there are as many as 1 million such “American” citizens living in China who could demand the rights and privileges of US citizenship in our country.

Being a leading constitutional scholar on critical issues such as this is why the left wants me disbarred and removed from the practice of law. They know that my scholarship and arguments are not only credible, they are also often highly persuasive with judges (including Supreme Court justices) and with elected officials, including the President of the United States.

Unfortunately, the lawfare left has bled by legal defense fund dry with all their vicious attacks against me. My fund is nearly out of money but we still have major battles left to win in California and Arizona.
