February 19, 2025 – Your $100,000 Debt

If you’re like most people, you probably keep close track of your financial obligations – credit card debt, mortgage balance, student loans, etc. But there’s a big debt that you probably haven’t factored into your financial planning – your $100,000 share of America’s $37 trillion national debt.

A married couple together owes $200,000. A family of four is in the hole to the tune of $400,000.

II am the primary advocate of a solution to the national debt crisis that the left views as radical, and I am urging President Trump, Elon Musk and their Department Of Government Efficiency (DOGE) to pursue it.

It’s my legal scholarship on this and other important constitutional issues that is in large part at the root of the lawfare left’s passionate desire to destroy me and end my legal career.

The reason that America is in such debt is that Congress has been allowed to unconstitutionally spend whatever it wishes on pork and pet projects at home. In fact, the adage that a member of Congress who “brings home the bacon” has become a badge of honor and something to campaign on for reelection.

Our national founders rejected this path to spending taxpayer dollars, which they correctly predicted would undermine the nation’s fiscal foundation, and wrote the Constitution to prohibit it.

Article 1, Section 8, Clause 1 of the US Constitution gives Congress the power, “to pay debts and provide for the common Defense and general Welfare of the United States.”

The lawfare left targeted me for attack because I had the courage to represent President Trump and help him shine a light on illegalities and irregularities in the 2020 president election. But in addition, they want to keep me off the legal field and prevent me from battling against their expansionist liberal agenda.

Here’s what I am dealing with because of my success as a conservative constitutional scholar who represented President Trump:

I’ve been indicted in two states, had my law license made (temporarily) “inactive” in a third, and been forced to raise over $1.5 to pay for defense costs thus far. I’ll need at least that much more going forward.

Will you step forward to help me defeat the lawfare left and continue to fight for our Constitution and conservative principles like reigning in federal spending? I urgently need your help.

I’m urging President Trump and Elon Musk to take decisive action to reclaim the constitutional footing for Congress spending money by upholding an originalist interpretation of the Constitution’s spending clause.

For much of our history, our Founders took the position that the spending clause only permitted Congress to spend for general, “national” priorities. Though views differed on what constituted a general or national purpose (Madison’s and Jefferson’s views were narrower than Hamilton’s, for example), for the first 75 years of our country, almost every President agreed that Congress was permitted to spend only to pay debts and provide for a national defense and general (national) welfare.

Naturally, politicians and activist courts have over time eroded this constitutional principle, because spending money – bringing home the bacon – proved to be an irresistible impulse. In 1936 the US Supreme Court ruled in United States v Butler that federal spending must be related to a national purpose, but in 1987, some fifty years later, our highest Court essentially deferred to Congress to determine what furthered a “general welfare” purpose (South Dakota v Dole).

The Supreme Court seriously erred in allowing Congress to decide for itself whether its spending furthers a general (national) purpose. Look at the consequence since the spending floodgates were opened as a result of that ruling:

Federal spending has ballooned more than eight-fold from $847 billion in 1987 to approximately $7 trillion today. Annual deficits have grown nearly thirteen-fold from $148 billion to $1.9 trillion today. Even more ominously, our national debt has increased by sixteen-fold to the point where every man, woman and child in America is on the hook for $100,000 each.

Congress will never itself stop spending. They must be forced to do so, and the only way to do that is if President Donald Trump takes executive action to stop unconstitutional spending. 

That is the action I am asking of my friend and former client, Donald Trump, to undertake. Of course, such an action will be quickly blocked in the lower courts, in lawsuits brought by leftist organizations who believe, like Nancy Pelosi famously proclaimed, that Congress can spend our money for whatever purpose it wants.  But I believe when the issue does reach the US Supreme Court, our current (originalist, conservative) Court majority will agree with me and bring an end to the financial disaster their 1987 ruling created.

I am battling as hard as humanely possible to defeat the lawfare left so I can get back into the fight advancing conservative principles and upholding the Constitution.

It would be an honor to help President Trump and his team develop the right constitutional challenge to Congressional spending, and to even be part of the team defending his actions before the Supreme Court.

But unfortunately, I am stuck in lawfare hell, fighting for my freedom and livelihood. I’ve had to raise and spend over $1.5 million thus far, and am looking at needing that much again, or more, before all is said and done. That is why I humbly but fervently hope and pray that you are able to make a donation today to my legal defense fund of $25$50$100$250 or $500 or more.

The Trump election mandate of 2024 was many things, but two of those were to control our borders and reduce the size and scope of the federal government – including reducing every person’s $100,000 share of the staggering national debt. My legal scholarship is at the forefront of achieving both of these objectives. I hope with your help to defeat the lawfare radicals once and for all and to return my focus to upholding our Constitution and fighting for the rule of law and conservative legal principles.
