I was honored to speak last Friday at CPAC, which bills itself as the most influential gathering of conservatives in the world. It was humbling to be included among an unbelievably magnificent group of speakers, including Vice President JD Vance, “White House Tech Support” guru Elon Musk (yes, that’s how he described himself on his X account!), Attorney General Pam Bondi, and last but not least, President Trump himself.
As you might imagine, I spoke about lawfare. You’re familiar, I hope, with the broad outlines of the lawfare attacks I have faced. Because of my work for President Trump in bringing forth concerns about election illegalities and irregularities in 2020, I have been indicted by partisan prosecutors in two states, had my law license made temporarily “inactive” thanks to a disbarment case in a third, been made a target of Jack Smith at the federal level, been summoned before the discredited Liz Cheney-run J6 Committee in Congress and had to expend over $1.5 million on legal fees so far – with the amount rising every day.

I tried to use my CPAC speech to share some personal observations about what I’ve been through and my reactions to what has been going on. I’ve included a link to my remarks at the end, but there are a couple of anecdotes I want to share with you directly that are not generally in the public domain to provide some “color commentary” to my ordeal.
The FBI accosted me in New Mexico in the parking lot of a restaurant and confiscated my phone, using an egregiously broad warrant demanding “all the data on your phone.” We fought a revolutionary war to stop that. It’s called a “general warrant.” The 4th amendment requires that the government identify what they are going to search and seize with particularity. The official just said “everything on your phone.” Of course, modern phones are a portal to everything – every communication, every transaction, every account you have, every photo, even your taste in music. I was promised they would not look at that information without a second warrant. About a month later, I start getting inquiries from their team in Portland Oregon asking about certain matters and whether I was going to assert privilege over them. I naturally replied, “I’ve got a question: How do you even have that? Where is the second warrant?” The response was, “Oh, we got that.” I replied that I hadn’t seen it and their response was astonishing. “Well, yeah, but the phone was in our possession by then so we served the warrant on ourselves.”
This is utter nonsense, a weaponized FBI and Department of Justice. They are shredding the First Amendment, the Fourth Amendment, the Fifth Amendment and the Sixth Amendment.
I had a client once who didn’t always pay attention to time zones. One day my wife nudged me at 4:30 in the morning while we were sleeping and my phone pinged. She said it might be that client calling. It was. Well, the client was the President of the United States. He asked me to help him get the legal challenges to the fraudulent and illegal election in 2020 before the courts to consider.
I shared with the audience at CPAC how some people who might agree with me, ask, “Eastman why don’t you just look forward and not back. Let this go.” My answer is this: “If we don’t get to the bottom of what they did and hold the people who did it accountable, they will do it again the first opportunity they get.” There was widespread applause to my approach.
My fight against these lawfare attacks is not over, but I think, with Kash Patel’s confirmation as FBI Director and Pam Bondi as Attorney General, we’re going to start to see those who have engaged in this egregious weaponization of our criminal justice system on the receiving end of criminal investigations themselves.

I ended my remarks at CPAC with these comments, reflecting on the last stanza of our National Anthem about our flag waving over the land of the free and the home of the brave:
“Ladies and gentlemen, I’ve got grandkids. I’m not willing to hand them over to the land of the cowards and the home of the slave. We fight this battle until we win. Until we win permanently. We fight it, we fight it every day. We fight it in the streets. We fight it in the courts. We fight it wherever we can. Because our freedom is too precious to give up.”
