July 17, 2024 – Briefs not bullets

America watched in horror as a would-be assassin tried to kill former President Donald J. Trump in Pennsylvania. Our former and very likely future president came within a fraction of an inch of losing his life. By God’s grace, Mr. Trump turned his head at the precise moment that the bullet was fired, and it grazed his face, ripping through his ear. Praise the Lord, he survived.

I shake my head at some of the commentary I’ve heard since the assassination attempt. Many have called it an “unthinkable act,” but that’s just spin. It’s quite thinkable and, in point of fact, logically follows from the extreme rhetoric that has been used to describe Mr. Trump and anyone associated with him.

Prominent Democrats, including the current president, Joe Biden, have called him a fascist and likened him to Hitler. They say he is a threat to democracy and the very survival of the nation. They claim he will rip up the constitution and rule as a dictator. This, they loudly shout, will be the last election in America if Donald Trump wins. One Democrat Congressman called for Trump to be “eliminated.” Biden himself called for people to put a “bullseye” on Trump.

Well, if you are an unhinged individual unable to separate irresponsible hyperbole from reality, what do you think is going to happen given this “evil” threat to the nation? Someone is going to be radicalized into action. Remember, in any movie plot about trying to take down Hitler, the would-be assassin is the hero of the story.

My career was built on the belief that law in America should come from argument, reason and debate. I believe that legal briefs, not bullets, should carry the day.

That’s why I worked hard to become one of the country’s foremost legal and constitutional scholars. It’s why I have authored hundreds of legal briefs and filed them in important cases in courts around the country, including more than two hundred cases before the US Supreme Court.

And it is why I agreed to President Trump’s request that I represent him and provide advice as to how he could lawfully bring forth challenges to illegalities and irregularities in the 2020 election. That decision has changed the course of my life.

From the moment I signed on to help President Trump, I have been targeted by a vicious assault on my character, reputation and legal standing. Thankfully, nobody has aimed a rifle at my head, but some on the left have said they want me dead. The hate and vitriol that my family and I have endured has been ruthless.

The lawfare assault on me has taken a big toll and is costing me millions. I can’t carry this burden alone, so I am asking for your support of my legal defense fund. Please be generous.

The power of a legal brief was made clear again in the dismissal of Jack Smith’s rogue prosecution of former President Trump in the classified documents case. Though I was not involved in that case, I have said for months that Smith’s appointment as Special Counsel was unconstitutional and violated the Appointments clause of the Constitution.  As Judge Cannon held, it also violated the Appropriations clause.

Judge Aileen Cannon has agreed with my assessment and dismissed the case against Mr. Trump. Her ruling came a few weeks after one of my mentors, Supreme Court Justice Clarence Thomas (for whom I clerked at the US Supreme Court) said in a concurring opinion in the presidential immunity case that Smith’s appointment was not proper.

The radical left does not like legal briefs they disagree with. So, they attack the integrity of the lawyers who file them and try to cause them harm in their own firms, with their other clients and with the public.

Lawfare certainly didn’t start with the left’s attacks on me, but it has been perfected by them in my case. They have succeeded in getting a California State Bar Court judge to recommend my disbarment. I’m appealing that outrageous decision but in the meantime am being prevented from practicing law in California and earning income as a lawyer.

I’ve been indicted, along with President Trump, in Georgia by the leftwing and ethically challenged Democrat DA Fani Willis. I’ve also been indicted by Arizona’s Democrat Attorney General, Kris Mayes, in a partisan witch hunt so outrageous that they would indict me even though I had nothing to do with challenging election results in Arizona.

The illegally appointed Special Counsel Jack Smith has also targeted me in his elections interference case against President Trump by naming me an unindicted co-conspirator.

I have already been forced to spend well over $1 million on legal fees to defend myself against the lawfare left who are targeting me. I will need to raise at least an additional $2 million going forward.
