I’m writing to update you on another shocking scandal emanating from the partisan Arizona Attorney General’s attempt to prosecute me for multiple falsely alleged felonies relating to my representation for President Donald Trump in his efforts in 2020 to raise concerns about irregularities and potential illegalities in that election.
The first scandal, of course, is that I am being prosecuted for anything in Arizona because I had nothing to do with challenging election results in that state. I did not represent President Trump in any of the election challenges in Arizona.
The second scandal relates to the conduct of the judge initially assigned to my case. I had filed what’s known as an anti-SLAPP motion to dismiss the case because of infringement of the First Amendment and egregious bias by the prosecutors (including frequent comparisons of President Trump and his supporters to Nazis!)
At the very same time the trial judge was hearing my anti-SLAPP motion, the judge emailed all the other judges on the court using a Nazi analogy to reference President Trump’s supporters and Mr. Trump’s campaign against Kamala Harris. When the emails came to light, one of my co-defendants filed a motion to require the judge to recuse himself, which he finally did last week.
That brings me to the third and latest scandal. There was an explosive document the AG’s office finally produced to us in discovery. It turns out that the State hired an outside, anti-Trump lawfare advocacy group to prepare a “prosecution memo” for them to follow targeting the group’s political opponents and many of President Trump’s lawyers and supporters, beginning with me. In fact, I am the first person named in the 47-page memo to AG Kris Mayes’ office after President Trump himself.
Shockingly, this prosecution strategy was pursued with the full cooperation of the Attorney General and she is following it!

You can see what I’m up against in Arizona. The state’s partisan Attorney General, Kris Mayes, is following the script written by a radical anti-Trump lawfare group to prosecute me even though I wasn’t involved in bringing Arizona challenges. This development is a shocking abuse of power – the very kind of abuse that President Franklin Roosevelt’s attorney general, Robert Jackson, warned against, namely, to go after someone you don’t like and scour the law books to try to find some provision of the criminal law that might be stretched to cover them. It’s the same tactic that Stalin’s head of secret police, Lavrenty Beria, famously deployed against Stalin’s opponents: “Show me the man and I’ll show you the crime.”
I am working hard with my legal team to consider our next steps in Arizona. With a new judge assigned to the case who will have to get up to speed on the very complicated issues already before the court. He’ll have little choice but to reschedule hearings and may ask for additional materials. This means my team will have to spend considerable time – at considerable expense to me – getting a new judge familiar with the issues, including my pending motions to dismiss the case.

The previous judge had set the trial for January 2026, forcing me to fund my legal team to be engaged for a year and a half before I ever get my day in court. It’s not known if this timeframe will be pushed back further given the appointment of a new judge.
Meanwhile, my team and I are strategizing over steps that should be taken in light of the shocking revelation that this entire prosecution has been scripted by an outside lawfare group with the complicit involvement of Arizona’s Attorney General.
This is a grotesque violation of prosecutorial ethics. Prosecutors are obligated by ethical canons to represent the people, not special interest groups with a decided grudge against an accused. We believe that this revelation is a new and powerful reason for the case against me to be dismissed, and we are evaluating the best procedures to utilize to do so.
What’s going on in Arizona is just one of the things my family and I are having to deal with. I continue to fight the outrageous attempt by a California State Bar judge to recommend my disbarment because of my representation of President Trump. And I am embroiled in new, complex legal actions in Georgia seeking to get that prosecution dismissed as well.
So as you can see, we have much work before us in these three state battles if we are to ultimately prevail.
